Terms and Conditions
- Please check that your name on the contract is spelt correctly and as you would wish it to appear on any certificates awarded.
- All payments are non-returnable. Insurance against injury, illness, travel disruption etc. is strongly recommended.
- COVID-19 – Lionheart Pilotage will issue refunds or reschedule swims where travel restrictions prevent the swimmer from travelling to Jersey or the swim from being able to take place. Lionheart Pilotage will not be liable for any disruption to training etc caused by local, national or international restrictions eg pool closures etc.
- If the swim is cancelled due to bad weather, a new, mutually convenient slot will be offered. No refund of any fees or other costs will be given.
- If the swim is cancelled due to breakdown or a problem on the behalf of Lionheart Pilotage, our maximum liability will be the refund of deposit/fees already paid to us directly for the pilot and boat only.
- Payment schedule: 50% of the total swim fee must be paid within 7 days of receipt of the contract to secure your slot. The remaining 50% must be paid before 31st January in the year of your swim.
- If you do not keep to this schedule, we reserve the right to cancel or delay your booking.
- All payments made are non-refundable and non-transferable as it is too late at this point to offer your slot to a new swimmer. You may, however, change the nature of your slot from solo to relay and vice versa provided this is agreed with your chosen ratifying authority and Lionheart Pilotage.
- If you fail to meet the requirements and deadlines as set by the ratifying authority and as a result your swim is not cleared to proceed, no refund will be made. It is your responsibility to ensure you comply with the requirements of the ratifying authority.
- Any physical or medical conditions and medication being taken must be declared to the pilot before the start of the swim if it has any potential of requiring special consideration or possible assistance. The place where the medication is stored must be known by a member of the support team.
- Lionheart Pilotage will advise on the weather and sea conditions on and before the day of the swim and say if we think it is possible for an attempt to take place. It is, however, the responsibility of the swimmer(s) and their support team to agree the final decision to make an attempt. The swimmer(s) should know their capabilities before they make such a decision as these vary considerably from person to person. Open water swimming is an extreme sport that has its dangers. It is the swimmer(s) and their team’s duty to know the challenge they are undertaking and be aware of the possible conditions that may be involved. They are responsible for their own actions. Be aware that sea sickness can be a serious problem for the support team members on the boat.
- This agreement is for piloting an attempt to swim the agreed course, regardless of the length of time taken to make the attempt. The swim will be deemed to have started as soon as the swimmer enters the water at the start of the attempt. Whenever the swim ceases after this time the full fee will be retained as per the agreement.
- The escort craft will have the required commercial certification and be to the standard required to undertake open water swimming escort duties in the Channel Islands. Both the craft and the pilot will be registered as required by the Jersey, Guernsey and French Coastguard authorities and the UK Maritime and Coastguard Agency.
- It is the swimmer(s)’ responsibility to supply light sticks, clothing, food, grease and any other personal equipment they might require for the swim. Please consult us if you need any assistance to obtain these items or guidance on these matters.
- The swimmer / team must notify us of their arrival in Jersey and give us a contact telephone number. They should advise us as soon as they are ready to attempt their swim (a minimum of 24 hours is required to set up boat, pilot and observer).
- The information on this form will be entered in to our database. Relevant information about your booking may also be passed on to your ratifying authority if you have elected to use one. Any objections to these entries or special requests regarding their use must be registered with us in writing when returning this form and confirming this booking.
- Maximum number of support crew to be permitted onboard: 6 person relay – nil (unless for a junior relay and adult chaperones are required); 5 person relay – nil; 4 person relay – nil; 3 person relay – 1; 2 person relay – 2; Solo – 3.
